These Terms of Service (“Terms”) govern your use of the services provided by TSW Agency (“we,” “our,” or “us”). By accessing or using our website or platform, you agree to these Terms.

TSW Agency offers:

Done-for-you website and funnel builds

Automated CRM and email systems

HIPAA-compliant hosting tier

Social media management

Blog creation and SEO

Course or membership hosting

All services are customized and may include setup fees and recurring monthly fees.

3. Accounts and Access

You are responsible for maintaining the confidentiality of your account login credentials. You agree not to share, resell, or misuse the platform in a way that could compromise security or performance.

4. Payments and Subscriptions

All payments are processed securely through Stripe on behalf of TSW Agency.

Setup fees are due before project initiation.

Monthly subscriptions renew automatically unless canceled.

Cancellation requests must be submitted in writing at least 7 days before the next billing cycle.

Refunds are handled on a case-by-case basis and are generally not issued after service activation or system delivery.

5. Client Data and Confidentiality

You retain ownership of your business and client data. We will never sell, share, or access your data except as required for support, maintenance, or legal compliance.

If you select a HIPAA-compliant plan, TSW Agency provides the secure infrastructure required but does not act as your Business Associate unless a separate agreement is signed.

6. Intellectual Property

All software, designs, workflows, and templates created by TSW Agency remain our intellectual property unless expressly transferred in writing. You receive a license to use these assets while your subscription is active.

7. Acceptable Use

You agree not to use our services to:

Send spam or unsolicited messages

Host or distribute illegal or harmful content

Infringe on others’ intellectual property

Misrepresent your business or credentials

Violation of these terms may result in suspension or termination of your account.

8. Limitation of Liability

TSW Agency provides its services “as is” and makes no guarantees about uptime, performance, or specific business outcomes.
We are not liable for indirect, incidental, or consequential damages, including lost revenue, arising from the use of our services.

9. Independent Contractor Relationship

TSW Agency may collaborate with independent contractors to complete projects. These contractors do not represent clients directly and operate under the supervision of TSW Agency.

10. Dispute Resolution

These Terms are governed by the laws of the State of Florida, USA.
Any disputes shall first be attempted to resolve amicably. If unresolved, disputes will be subject to binding arbitration in Florida.

11. Termination

You may terminate your account at any time by contacting us. TSW Agency reserves the right to terminate accounts for violation of these Terms or non-payment.

12. Updates to These Terms

We may modify these Terms occasionally. Continued use of our services constitutes acceptance of the updated Terms.
